Contrato de Compra Venta

CONTRATO  DE COMPRA VENTA: TERMINOS Y CONDICIONES DE VENTA.

En MOLTO SPÁZIO, agradecemos muy cordialmente su compra y preferencia, así mismo le reiteramos  nuestro firme compromiso de servirle y satisfacer sus necesidades más allá de lo que Ud., espera. Es por eso que su opinión es muy importante por lo que si tiene cualquier queja o sugerencia, le agradeceremos envíe sus comentarios a: Esta dirección electrónica esta protegida contra spambots. Es necesario activar Javascript para visualizarla dicho lo anterior, sirva este documento para plasmar por escrito las cláusulas contractuales de la operación de compra con la  que nos ha favorecido:

GARANTIA:  El producto cuenta con garantía contra defectos de fabricación de 2 años.  No garantizamos los productos que no nos hayan sido comprados directamente y que hayan sido adquiridos por cualquier otro medio de comercialización.  Muchos de nuestros muebles están fabricados con madera sólida cuidadosamente seleccionada y bajo un control de calidad  ya que ésta le da al mueble mayor duración, belleza y carácter, sin embargo, a pesar de que nosotros sólo hacemos uso de madera sólidas secadas en estufa, la madera puede trabajar y en ocasiones abrirse o rajarse de la misma manera por ser un producto natural pueden existir variantes en el tono de las vetas. Este potencial problema no es un defecto de fabricación, es incluso gustado y apreciado por consumidores que perciben que la construcción es de madera sólida y no de tableros o aglomerados. Por lo anterior expuesto, no nos hacemos responsables del costo de reparar un mueble que se abra o raje o en los tonos del mismo.  Si Usted gusta, será un placer cotizarle la reparación pertinente, y si Ud., acepta el presupuesto y nos cubre el anticipo del 50%, entonces empezaremos el trabajo de reparación. Una vez terminada la reparación le daremos aviso para que revise su mueble si así lo desea, y para que nos liquide el 50% restante.  Si el pago es con cheque en moneda nacional o con cheque en USD situado en México, la entrega será realizada hasta el buen cobro del mismo.  El color de la madera, de sus diferentes vetas y sus variaciones de grano son atributos naturales del mueble fino o cual no es considerado un defecto sino parte de su belleza natural. Debido a esta circunstancia no garantizamos los patrones de la madera en nuestros productos, ni las variaciones de los mismos en cualquiera de nuestros muebles.

No garantizamos la comodidad o su percepción de la misma en nuestros productos. Tampoco le garantizamos la exactitud en colores, ni el encogimiento en la telas, viniles y productos de piel. No garantizamos productos protectores de tela, ni protectores de piel. No garantizamos escurrimientos en los muebles de fierro al óxido, debido a que éste es producto del proceso natural que este material sufre para oxidarse. Nuestros productos son para uso en interiores , por lo que le solicitamos que no exponga sus muebles a exteriores, ni al agua y tampoco a los rayos solares, ya que bajo circunstancias pierde automáticamente la garantía de nuestros artículos. Las ventas de productos localizados en el piso de venta son “como el producto se muestra”, esto en  las condiciones en que se exhibe el producto.

No garantizamos que el muble se ajuste a un espacio determinado por Usted como destino para el mismo. Tampoco podemos garantizarle su satisfacción  por la apariencia del mismo en la decoración de su casa u oficina. Nos encantará asesorarle, o que se asesore con algún profesional de la decoración de su preferencia, o que tome Usted las medidas de los espacios y se asegure que no tendrá problema alguno al ubicar el mueble en su casa u oficina.

FORMA DE PAGO:  Los productos ordenados sobre pedidos se turnarán a producción hasta la recepción del 50% del depósito del precio neto de venta. El finiquito deberá realizarse previo a la entrega, considerándose el pago realizado hasta que el banco nos haya corroborado que los fondos están ingresados en nuestra cuenta, que hubo cobro y que no hay manera de sufrir un ulterior cargo.
La forma de pago es un derecho que en MOLTO SPÁZIO poseemos y ejercemos como política interna. Al carecer de un departamento de crédito, que encarecería el costo del producto, tenemos que buscar una manera de asegurarnos del buen cobro de cheques, por lo que no hacemos ninguna entrega hasta que contamos  con la acreditación definitiva por parte del banco. Los depósitos y finiquitos pueden ser pagados en efectivo, cheque certificado, cheque de caja, transferencia electrónica, tarjeta de crédito, ó giro bancario, etc.; si el producto es de importación, el anticipo y el finiquito deberán ser liquidados de las siguientes dos formas: (1) En moneda nacional al tipo de cambio del USD a la compra en ventanilla del momento del anticipo y del momento del finiquito, o (2) en USD en efectivo o en cheque en USD situados en México del momento del anticipo y del momento del finiquito.

CANCELACIÓN.  La cancelación de compras de productos de exhibición y de este contrato de compra-venta por parte del cliente resultará en un cargo de cancelación del 30% sobre el precio lleno del producto ( calculado este cargo descontando cualquier tipo de descuento, promoción o rebaja), y puede ser efectuada no más allá de 45 días fecha factura. Cuando la cancelación de la compra es de artículos sobre pedido el cargo será del 50% del total de la venta ( el 100% del anticipo recibido).

TIEMPO DE ENTREGA:  El tiempo de entrega es una estimación. Cuando le confirmemos la fecha de entrega, requeriremos que nos liquide el saldo una semana antes de la entrega (pagos en moneda nacional y en cheques en USD situados en México). En caso de pedidos  en donde el cliente proporciona la tela, piel u otros materiales, el período de entrega empieza a contar a partir de la fecha de la recepción de estos materiales.

CARGOS POR ENTREGA:  Entregamos en la Ciudad de México y en su área metropolitana sin costo, siempre y cuando sus puertas, baños y escaleras permitan el acceso en caso de que la entrega requiera maniobras especiales, el costo y riesgo será asumido por Usted.

CAMBIOS EN LA ENTREGA REQUERIDOS POR EL CLIENTE:  Sólo podemos cambiar su entrega si Usted nos avisa del cambio a más tardar a las 11:30 a.m., del día inmediato anterior programado para la entrega inicial. El costo de las entregas es alto, por lo que de enviarle sus muebles y no haber quien los reciba, nos obligará a cobrarle el costo de este flete.

ALMACENAMIENTO DE PRODUCTOS DEL CLIENTE EN NUESTRAS BODEGAS.  Si Usted retrasa por más de 30 días, nos veremos obligados a hacerle cargos de almacenamiento del orden del 3% mensual sobre el importe total del pedido. Si la entrega no es realizada en 60 días de la fecha originalmente estimada de entrega, los productos anotados en este contrato se considerarán abandonados y por tanto las penas de cancelación aplicarán según se ha expuesto previamente.

AL RECIBIR SUS MUEBLES: Usted deberá verificar las maniobras de nuestros productos en cuartos, corredores, escaleras y elevadores y deberá revisar los productos en la entrega. Si usted acepta la entrega es porque habrá dado su consentimiento de que no existen defectos. Nosotros no, somos ni seremos responsables , ni ofreceremos garantía alguna, contra defectos notificados a nosotros después de la fecha de entrega. Por favor inspeccione sus bienes muy cuidadosamente.

FACTURACIÓN:  Nosotros retenemos su factura hasta que los bienes nos son liquidados por completo. Una vez inspeccionados y aceptados como recibidos en buenas condiciones por Ud., o por su representante, éstos le pertenecen. Nosotros no tenemos obligación de rembolsar, ni cambiar, ni aceptar devoluciones, una vez que este contrato sea llenado y firmado. Todas las ventas son finales.

ERRORES Y OTROS: Errores en precios y errores aritméticos son sujetos a corrección. Los términos y condiciones de este contrato representan el acuerdo total entre las partes y el entendimiento relacionado a la materia del mismo, y están por arriba de cualquier otro contrato previo. Si el cliente rompe este contrato, y en adición a otros recursos previstos por la ley, además de recobrar cualquier saldo que se nos deba por razón de este contrato, el cliente se obliga a pagar un interés del 6% mensual, más costo de corte, honorarios de abogados y cualesquiera otro tipo de costos judiciales y gastos en los que incurramos para cobrar lo que por este contrato y por ley nos corresponde. No hay más garantías que las que se extienden bajo los términos aquí  descritos, de las condiciones de venta y de la descripción contenida en este contrato.

If You like, will be a pleasure to quote the pertinent repair, and if you, accept the budget and cover the advance payment to us with 50%, then we will begin the work of repair. The color of the wood, its different veins and their variations from grain is natural attributes of the fine furniture or what is not considered a defect but part of its natural beauty. Due to this circumstance we did not guarantee the landlords of the wood in our products, nor the variations of the same in anyone of our furniture. We did not guarantee the comfort or its perception of the same in our products. We either did not guarantee the exactitude in colors, nor the shrinking in fabrics, viniles and products  of skin. We did not guarantee skin protective fabric products, or protective. We did not guarantee draining in the furniture of iron to oxide, because this one is product of the natural process that this material suffers to oxidize. Our products are for use in interiors, reason why we solicited to you that it does not exhibit its furniture to exteriors, nor to the water and either to solar rays, since under circumstances automatically loses the guarantee of our articles. The product sales located in the sale floor are “as the product is”, this in the conditions in which the product is exhibited. We did not guarantee that the furniture adjusts to a space determined by You as destiny for the same. We cannot either guarantee its satisfaction to him by the appearance of the same in the decoration of its house or office. It will be a pleasuret to advise to us, or that consults some professional of the decoration of its preference, or that you take measures of the spaces and make sure that some when locating will not have problem the furniture in its house, apartment, office, etc…

MODE OF PAYMENT: The products ordered on orders will be alternated to production until the reception of 50% of the deposit of the net price of the sale. The settlement will have to be realized previous to the delivery, considering itself the realized payment until the bank has corroborated to us that the bottoms are entered our account, that was collected and that is no way to undergo a later position. The mode of payment is a right that in MOLTO SPÁZIO we own and we exert like political intern. When lacking a credit department, that would increase in price the cost of the product, we must look for a way to assure to us the good collection of checks or payments, reason why we do not make any delivery until we counted on the definitive accreditation on the part of the bank. The deposits and settlements can be paid in cash, check certificate, check of box, electronic transference, credit card, or bank draft, etc.; if the product is of import, the advance payment and the settlement will have to be eliminated of the following two forms: (1) In national currency to the type of change of the USD to the purchase in window of the moment of the advance payment and the moment of the settlement, or (2) in USD in cash or check in USD located in Mexico of the moment of the advance payment and the moment of the settlement.

CANCELLATION. The cancellation of product purchases of exhibition or on this contract of transaction on the part of the client will be in a cancellation position of 30% on the full price of the product (calculated east position discounting any type of discount, promotion or reduces), and can be carried out beyond 45 days date does not invoice. When the cancellation of the purchase is of articles on order the position will be of 50% of the total of the sale (the 100% of the received advance payment).

TIME OF DELIVERY: The time of delivery is an estimation. In case of orders where the client provides the fabric, skin or other materials, the period of delivery begins to count as of the date of the reception of these materials.

POSITIONS BY DELIVERY: We deliver in Mexico City and in his metropolitan area without cost, as long as their doors, baths and stairs allow the access in case the delivery requires special maneuvers, the cost and risk will be assumed by the client.

CHANGES IN THE DELIVERY REQUIRED BY THE CLIENT: We only can change its delivery if You warn to us of the change taking more to the 11:30 a.m., of the programmed previous immediate day for the initial issue. The cost of the deliveries is high, reason why to send its furniture to you and nonbe one receives, will force to us to acquire the cost to you of this load.

PRODUCT STORAGE OF THE CLIENT IN OUR WAREHOUSES. If You delay by more than 30 days, we will be forced to do positions of storage of the order of monthly 3% on the total amount of the order. If the delivery is not realized in 60 days of the date originally considered of delivery, the products written down in this contract will be considered left and therefore the cancellation pains will apply according to has been exposed previously.

WHEN RECEIVING ITS FURNITURE: You will have to verify the maneuvers of our products in quarters, runners, stairs and elevators and will have to review products in the delivery. If you accept the delivery is because you will have given your consent of which defects do not exist. We no, are neither will be responsible, nor will offer guarantee some, against defects notified after the date of delivery. Please  inspects you goods very carefully.
INVOICING: We retain their invoice until the goods are eliminated to us completely. Once inspected and accepted like received in good conditions by You, or his representative, these they belong to. We have no obligation to refund, change, or accept returns, once this contract is filled and signed. All the sales are final.

ERRORS AND OTHERS: Errors in arithmetic prices and errors are subject to correction. The terms and conditions of this contract represent the total agreement between the parts and the related understanding the matter of the same, and are in favor of above of any other previous contract. If the client breaks east contract, and in addition to other resources anticipated by the law, besides recovering any balance that must to us because of this contract, the client commits itself to pay an interest of monthly 6%, more cost of cuts, honoraria of lawyers and any other type of judicial costs and expenses in which we incur to receive what by this contract and law corresponds to us. There are no more guarantees than those than they extend under the terms described here, of the conditions of sale and the description contained in this contract.
